This Usage Policy outlines the terms and conditions governing the acceptable use of the Heidi Platform developed by and operated by Heidi Health Trading Pty Limited (ABN 84 649 783 871) (Heidi, we, us, our) and our affiliates. The Heidi Platform is designed to provide support in the delivery of health services, including clinical workflow management, access to medical information about patients, and AI-powered evidence synthesis from peer-reviewed clinical studies and clinical-practice guidelines. The Heidi Platform integrates AI functionality to support administrative and clinical decision-making processes, including clinical decision support tools, and serves as a tool for assisting in the delivery of telehealth services through telephone, video, and chat functionality.
1. Purpose
Our mission is to pioneer the development of artificial intelligence that enhances the cognitive abilities of a seasoned medical practitioner. We are committed to redefining the healthcare landscape by introducing innovative solutions that seamlessly integrate with Electronic Health Records (EHR) and Practice Management Systems (PMS). Our groundbreaking approach empowers medical practitioners to significantly elevate their productivity through AI-driven task automation.
At its core, the Heidi Platform is dedicated to providing medical practitioners with indispensable AI tools that become invaluable partners in their day-to-day tasks. Through these tools, clinicians gain access to a new era of efficiency and precision in healthcare, enhancing patient care and streamlining healthcare operations.
2. AI Functionality
The AI functionality within the Heidi Platform is designed to assist medical practitioners in administrative and clinical decision-making processes. While the AI can provide insights and recommendations based on available data, it is imperative to understand that the final responsibility for all professional and medical decisions related to patient diagnosis, advice, treatment or the quality or accuracy of medical notes rests solely with the medical practitioner.
3. Limitations
3.1 No Replacement for Professional Medical Advice
The Heidi Platform and its outputs should not be construed as professional medical or healthcare advice, a definitive diagnosis, or a recommendation for treatment. It is not intended to directly assess, maintain, or improve the physical, mental, or emotional health of a patient.
3.2 Prohibited Uses
Users must use the Heidi Platform in a manner consistent with its intended purpose and this Usage Policy. Without limiting the foregoing, users must not:
(a) intentionally input fake, misleading, or deceptive data or prompts into the Heidi Platform, or attempt to request or manipulate the Heidi Platform into generating a clinical diagnosis, treatment recommendation, or other medical or health-related information of the kind described in section 3.1 (including by prompting for differential diagnoses or diagnostic outcomes);
(b) use any bot, script, or automated tool to access, scrape, harvest, index, copy, or systematically extract any content, data, or other materials from the Heidi Platform;
(c) reverse engineer, decompile, or otherwise attempt to discover the source code, models, or underlying technology of the Heidi Platform, except to the extent applicable law permits;
(d) circumvent, disable, or interfere with any rate limits, usage caps, security features, or other technical restrictions applied to the Heidi Platform;
(e) use the Heidi Platform or its outputs to develop, train, or improve any competing artificial intelligence model or service; or
(f) use the Heidi Platform in violation of any applicable law or in a manner that infringes the rights of any third party.
Any breach of this section may result in immediate suspension or termination of access in accordance with section 9.
3.3 Restrictions on use
Heidi reserves the right to place reasonable limitations on use of the products or features (including, without limitation, rate limiting, caps on queries, restricted access to certain features) (i) where Heidi considers that such use goes beyond what is reasonable and expected use, or is inconsistent with this Usage Policy; or (ii) otherwise in Heidi’s discretion.
Where Heidi imposes such limitations, Heidi may offer users the option to purchase a higher tier plan or subscription to access expanded usage allowances and avoid such limitations.
If Heidi reasonably believes that a user has breached this Usage Policy, or that suspension is necessary to protect Heidi, its users, or any third party, Heidi may suspend, restrict, or terminate that user’s access to the Heidi Platform, in whole or in part, with or without prior notice.
3.4 Review and Verification by Users
Users are responsible for reviewing and verifying the accuracy of all outputs generated by the Heidi Platform (including notes, summaries, translations, and Evidence outputs) before relying on them for clinical decision-making or patient care. For the avoidance of doubt, users remain responsible even where Heidi offers functionality designed to assist users to verify outputs.
Healthcare providers must exercise independent professional judgment when assessing whether any output is clinically relevant, accurate, and appropriate for the patient in front of them.
4. Disclaimer of Warranties
Except as otherwise provided in applicable terms, the Heidi Platform is provided “as is” and without warranties of any kind, either express or implied. Heidi disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Users acknowledge that the Heidi Platform may not be free from errors or inaccuracies and is not intended to provide medical advice.
5. Translation Feature
The Translation Feature (“Translation”) within the Heidi Platform enables healthcare providers to conduct medical appointments in one language and generate summary notes in another language. By using the Translation, users agree to the terms outlined in this Usage Policy.
5.1 Language Fluency Requirement
Translation is intended for use by healthcare providers who are fluent in both the input and output languages. Users must possess language skills sufficient to independently assess the accuracy of translation outputs, identify errors or misinterpretations, and review translated content before relying on it for clinical decision-making or patient care.
5.2 Feedback and Improvements
Participation in the beta testing phase requires active feedback from users regarding their experience with Translation, including reporting inaccuracies and suggesting improvements. Heidi is committed to enhancing Translation based on user feedback and may adjust the technology accordingly. Translation is currently in a beta testing stage. Users are encouraged to provide feedback on the accuracy and functionality of the translations to help Heidi improve the Translation feature. 6. Heidi Comms
The Heidi Comms Feature (“Heidi Comms”) made available through the Heidi Platform is an AI-powered voice assistant that facilitates voice-based interactions through inbound and outbound phone Heidi Comms for administrative purposes. By using Heidi Comms, Users agree to all the terms outlined in this Usage Policy. Please see our Privacy Policy for details on data handling and processing related to Heidi Comms.
6.1 Scope of Use
Heidi Comms is only intended to be used for lawful purposes and in a manner consistent with its intended administrative support functions. Heidi Comms is not intended to be used for emergencies or to provide direct medical advice, diagnosis, or treatment.
6.2 AI Engagement Disclosure
Heidi Comms is an AI voice assistant that uses speech recognition and natural language processing to interact with patients. Users are responsible for ensuring that patients are informed when they may be engaging with an AI system rather than a human, whether through outbound or inbound communications. Clinicians should also obtain informed consent in accordance with practice-specific requirements and any applicable legal or regulatory processes.
7. Evidence Feature
The Evidence Feature (“Evidence”) made available through the Heidi Platform is an AI-powered research tool that provides access to synthesised information from peer-reviewed clinical studies, clinical practice guidelines, and other medical literature. By using Evidence, Users agree to the terms outlined in this Usage Policy and our Privacy Policy.
7.1 Scope of Use
Evidence is intended to support clinicians in accessing and understanding medical literature and clinical guidelines for research and educational purposes. Evidence is designed to inform, not to drive, clinical decision-making, and must not be used as a substitute for independent clinical judgment or patient-specific care decisions.
7.2 In-Session Use and Patient Context
Evidence may be used while an active consultation session is in progress. Where patient context informs a query, Users are responsible for ensuring that any patient-identifiable information is handled in accordance with applicable privacy laws.
In-session Evidence (only available in some jurisdictions) queries and outputs are stored as part of the clinical session record and are subject to the same retention, deletion, and access controls that apply to session data on the Heidi Platform.
Users must not use Evidence to seek a diagnosis, a definitive treatment recommendation, or any output intended to substitute for their own clinical assessment of the patient.
7.3 Accuracy and Source Verification
Evidence uses AI to synthesise information from medical literature and guidelines. Users are responsible for independently verifying any information before applying it to clinical practice, including reviewing original source materials where possible. The absence of a response from Evidence should not be interpreted as confirmation that no research exists on a topic.
7.4 Sharing Evidence Outputs
When sharing Evidence outputs, Users must ensure no patient-identifiable information is included. Users are responsible for ensuring any sharing complies with applicable privacy laws and organisational policies.
8. Reliance on Heidi
Medical practitioners using the Heidi Platform must exercise caution and critical judgment when interpreting its outputs. The Heidi Platform provides administrative support and access to synthesized clinical research, but should not replace independent clinical judgment or serve as the sole basis for clinical decision-making. Medical practitioners should always ensure that any recommendations or information obtained from the Heidi Platform are thoroughly reviewed, corroborated with additional sources, and integrated into their overall decision-making process. The ultimate responsibility for patient care and decisions lies with the medical practitioner.
9. Compliance with Regulations
Heidi develops and operates the Heidi Platform to support compliance with applicable healthcare data and privacy regulations, including the Privacy Act 1988 (AUS), the HIPAA (US) and the GDPR (EU/UK). Users are responsible for ensuring their use of the Heidi Platform complies with all laws, regulations, and professional standards applicable in their jurisdiction, including any licensing, scope-of-practice, informed consent, record-keeping, and patient-confidentiality obligations.
10. Data Privacy and Security
Medical practitioners using the Heidi Platform must adhere to all data privacy and security protocols established by Heidi to protect patient information and maintain the confidentiality of healthcare data as outlined within.
11. Reporting Issues
Any concerns or issues related to the Heidi Platform’s performance, functionality, or adherence to this Usage Policy should be reported promptly to Heidi for investigation and resolution.
12. General
Heidi reserves the right to amend or modify this Usage Policy at any time. Users will be notified of any changes, and it is the responsibility of the medical practitioners to review and adhere to the updated policy. By using the Heidi Platform, users acknowledge that they have read and understood this Usage Policy together with applicable terms of use and agree to abide by such terms.
